LIMITATIONS OF LIABILITY

In no event shall Brennan Jacobs Inc or any of its subsidiaries or affiliates be liable for any indirect, special, incidental or consequential damages including but not limited to loss of use, loss of data, loss of business or profits.

Prices are subject to change without notice. Brennan Jacobs Inc, is not responsible for typographical errors.

PAYMENT TERMS

Terms of payment are within Brennan Jacobs Inc’s sole discretion, and unless otherwise agreed to by Brennan Jacobs Inc, payment must be received by Brennan Jacobs Inc prior to Brennan Jacobs Inc’s acceptance of an order. Payment for the products will be made by credit card, wire transfer, or some other prearranged payment method, unless credit terms have been agreed to by Brennnan Jacobs Inc. Invoices are due and payable within the time period noted on the invoice, measured from the date of the invoice. Brennan Jacobs Inc may invoice parts of an order separately. Orders are not binding upon Brennan Jacobs Inc until accepted by Brennan Jacobs Inc. Any quotations given by Brennan Jacobs Inc will be valid for the period stated on the quotation. Customer agrees to pay interest (Late Fee) on all past-due sums at the highest rate allowed by law. Invoices have 5 day grace period, after grace period late fee is calculated from the invoice date.

Use Tax Reporting Obligations

Unless otherwise specified on an order or quote, use tax may be due in connection with the purchase and delivery of tangible personal property to individuals and Businesses. Purchasers are required to file a use tax return if tax is due in connection with any purchase. Under many state laws, purchases are not tax-exempt merely because Brennan Jacobs Inc is not required to collect sales tax. Many state laws require purchasers to review untaxed purchases and, if any tax is owed, file the appropriate use tax return and pay any tax due. Many state laws require disclosure of the statutes for retailers to provide this use tax disclosure. In some states, the amount of Brennan Jacobs Inc sales into the state fall below thresholds set by the state or Brennan Jacobs Inc is registered to collect and remit sales tax in the state.

WARRANTY LIMITATIONS

Brennan Jacobs Inc, warrants products it manufactures against defects in materials and workmanship for a period of one year from date of receipt by the purchaser or his customer or one year from time of completion of initial field installation if installed by Brennan Jacobs Inc. Brennan Jacobs Inc, agrees to furnish the same or substantially similar replacement part (new or repaired) free of charge, F.O.B. site, providing the buyer gives immediate written notice of alleged defects and, if requested by Brennan Jacobs Inc, returns the defective parts to our factory, freight collect, for our inspection and examination.
  1. This warranty applies only to Brennan Jacob s Inc equipment or materials which, after our inspection are determined to be defective either in material supplied or workmanship performed by Brennan Jacobs Inc. Where equipment is furnished by Brennan Jacobs Inc but not of its manufacture, Brennan Jacobs Inc, liability is limited to such adjustment as the actual manufacturer makes to Brennan Jacobs Inc.
  2. Brennan Jacobs Inc, will not be liable for the cost of repairs, alterations, or replacements or any expense connected therewith made or incurred by the purchaser or his agents or employees, except upon written authority from the Brennan Jacobs Inc.
  3. This warranty is personal to purchaser only and applies only to equipment the purchaser has properly operated and maintained in accordance with Brennan Jacobs Inc, written instructions.
  4. Brennan Jacobs Inc, assumes no liability for any consequential damages suffered through the use or loss of use or its equipment.
  5. This constitutes Brennan Jacobs Inc, sole warranty with respect to the equipment and material manufactured by itself. Brennan Jacobs Inc makes no other warranty of any kind whatsoever, expressed or implied, and all implied warranties of merchantability and fitness for a particular purpose which exceed the aforementioned obligation are hereby disclaimed by Brennan Jacobs Inc.

Return Policy

  1. Customers must have authorization to return any product to Brennan Jacobs Inc. Customers must request an RMA (return material authorization) number from a Brennan Jacobs Inc Salesperson or Customer Service Representative. Please contact Brennan Jacobs Inc at 615.461.5152 fax at (615) 461-5152 or email at Service@Brennanjacobs.com to get a Return Material Authorization number.
  2. Customer has 30 days from shipment of material to request an RMA number. Possible warranty claims are an exception.
  3. Returned goods authorizations are valid for 21 days from the date of issuance.
  4. Any product sent to Brennan Jacobs Inc must be freight pre-paid unless approved by Brennan Jacobs Inc Customer Service Representative and noted on RMA Form. If freight is sent collect it will be refused.
  5. All items must be in new and unused condition. If product has been opened customer is subject to charges for inspecting the equipment. Customer is responsible for any reconditioning charges if applicable. Brennan Jacobs Inc reserves the right to return any products not in new and unused condition to the customer freight collect or at customer’s expense.
  6. The product must be returned in the original box to the destination advised by Brennan Jacobs Inc with the RMA number visible on the outside of the box. If material is sent without an RMA number the shipment will be refused. Customer is liable for all return shipping charges, and any additional charges such as storage.
  7. Custom and/or engineered products are non-returnable. Custom chain lengths (other than 10 feet -standard) on electric chain hoists are custom and a charge will be applied for the cost of the chain past 10 feet which is standard on the hoist.
  8. Restocking charges are set by our vendors. Typically, 20 percent is the restocking charge plus any freight or reconditioning charges. If additional restocking charges are required by our vendor, these will be paid by the customer.
  9. Brennan Jacobs Inc reserves the right; at their discretion to provide a refund via bank check in lieu of credit card refunds.

TITLE/RISK OF LOSS

Title to products and risk of loss passes from Brennan Jacobs Inc to you upon delivery to the carrier.

AMENDMENTS/APPLICABLE LAW

These terms and conditions may be amended at any time by Brennan Jacobs Inc. The laws of the State of Tennessee shall govern these Terms and Conditions.

Payment Options:

We accept Visa, Master Card, American express, Discover (Credit cards will be charged service fee that is charged by credit card processor) and 15-day net terms (credit application required). Other terms are available but have incur higher cost for longer terms. All quotes are assumed to be payment with order or net 15 day terms (with approved credit).
